data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tThe new Battery Implementation Act (BattDG) will come into force on <strong>18 August 2025<\/strong>.\n\nThe Act focuses on official responsibilities, registration obligations, data reporting and sanctions \u2013 not on the product characteristics of the batteries themselves. <strong>Anyone who places batteries or battery-powered products on the German market should prepare for the new regulations in advance.<\/strong>\n<h2><strong>Who does the BattDG apply to?<\/strong><\/h2>\nThe law applies to companies that do the following activities in Germany:\n<ul>\n \t<li>place batteries or devices with built-in batteries on the German market,<\/li>\n \t<li>commercially distribute, import or export batteries,<\/li>\n \t<li>offer batteries or battery-powered devices as an online retailer or platform operator,<\/li>\n \t<li>provide storage, packaging or shipping services as a fulfilment service provider.<\/li>\n<\/ul>\nManufacturers based outside Germany who supply directly to end users in Germany are also subject to the provisions of the BattDG.\n<h2><strong>Key obligations under the BattDG<\/strong><\/h2>\n<ol>\n \t<li>\n<h3><strong>Registration obligation<\/strong><\/h3>\nIn future, all manufacturers and importers must register with the Federal Office for Chemicals (BfC). Without registration, distribution in Germany is prohibited.\n<\/li><li>\n<h3><strong>Data reporting and notification obligations<\/strong><\/h3>\n\nCompanies must regularly provide information to the relevant authority:\n<ul>\n \t<li>Quantities of batteries placed on the market,<\/li>\n \t<li>Results of take-back and recycling,<\/li>\n \t<li>changes in company data or product categories.\n<\/ul><\/li><li>\n<h3><strong>Verification and documentation<\/strong><\/h3>\nTake-back systems and recycling processes must be verifiable and auditable.\n<\/li><li>\n<h3><strong>Take-back obligations<\/strong><\/h3>\nSuppliers must take back batteries <strong>free of charge<\/strong>. This applies to both the stationary and mail-order trade.\n<\/li><li>\n<h3><strong>Labelling and information obligations<\/strong><\/h3>\nEnd users must be informed, in a visible and comprehensible manner, that batteries can be returned free of charge after use and that they are legally obliged to return them. In addition, batteries must be labelled with the <strong>trash can symbol<\/strong>.\n\n<img decoding=\"async\" class=\"alignnone size-full wp-image-11230 aligncenter\" src=\"https:\/\/www.graulaw.eu\/wp-content\/uploads\/2025\/04\/Kosz1.png\" alt=\"\" width=\"106\" height=\"150\" \/>\n<\/li><li>\n<h3><strong>Obligations for online retailers and fulfilment service providers<\/strong><\/h3>\n<\/li>\nThese actors must ensure that a properly registered manufacturer is provided. Otherwise, they themselves may be liable.\n<\/ol>\n<h2><strong>New battery categories \u2013 with individual obligations<\/strong><\/h2>\nIn the course of the new regulation, the battery types were reclassified. Different obligations apply to each category \u2013 in particular with regard to registration, take-back, labelling and CO\u2082 certificate:\n<\/li><ol><li>\n<h3><strong> Device batteries<\/strong><\/h3>\nThese are batteries for everyday use. In the future, they must be easily removable and clearly labelled.\n<\/li><li>\n<h3><strong> Starter batteries<\/strong><\/h3>\nThese batteries are used in vehicles with combustion engines, e.g. for starting and lighting. They are subject to labelling requirements and will probably also be subject to traceability and CO\u2082 accounting requirements in the future.\n<\/li><li>\n<h3><strong> Traction batteries<\/strong><\/h3>\nThese are batteries for powering electric vehicles \u2013 such as in electric cars or e-buses. The most extensive obligations apply here: registration, battery passport, take-back, durability certificate, CO\u2082 balance and labelling.\n<\/li><li>\n<h3><strong> Industrial batteries<\/strong><\/h3>\nThese are used, for example, in solar systems, forklifts, UPS systems or stationary energy storage. They are also subject to registration and \u2013 depending on the type \u2013 battery passport and CO\u2082 documentation.\n<\/li><li>\n<h3><strong> Batteries for light vehicles<\/strong><\/h3>\nThis newly introduced category includes batteries for e-bikes, e-scooters, hoverboards and similar vehicles.
